2. Agreement to pay from the proceeds from closing the transaction only if the closing of the above described real estate is consummated pursuant to the terms of such contract of Sale of Real Estate. Both the Seller and the Broker agree to list the property for Total Services Amount shown above, but the above amount for limited services will remain the same and will be based on completion of the contract for sale not based on a percentage of the sale price. The final sales price will be between the buyer and the seller not the Broker. If the buyer does not accept the above agreed listing price for the property or contracts with a buyer who is not represented by a broker the buyer will still be bound to compensate the Broker at closing. If the property does not sell then the seller owes nothing.
This agreement shall be binding upon and shall inure to the benefit of the parties hereto, their respective heirs, personal representatives, successors’ and assigns.
